Notice of Privacy

This document constitutes the "Privacy Notice" of GEMTHUM SERVICIOS, SAPI DE CV, and its subsidiary companies (hereinafter "Gemthum"), in accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties. (hereinafter the "Law"). 
 
1.- Identity and address of the person in charge. 
 
GEMTHUM SERVICIOS, SAPI DE CV, with address in Ciudad del Carmen, Campeche, CP 24157, is responsible for the use and protection of your personal data. 
 
2.- Purpose of personal data processing. 
 
The personal data we collect from you will be used for the following purposes: 
 
Commercial purpose. 1) meet your request for a product or service, to formalize and register your contract, or to manage and operate the legal relationship that is generated; 2) marketing, advertising and commercial prospecting; 3) offer additional products or services to those already contracted with Gemthum; 4) inform you or invite you to participate in our non-profit activities of social commitment that aim to promote human development, through social, ecological and cultural projects; and 5) verify and confirm your identity. 
Security purpose in access to Gemthum facilities. 1) support, register and/or control the registration of people who access or visit Gemthum facilities; and 2) comply with the security guidelines established in Gemthum's internal policies.
 
3.- Personal data processed. 
 
To carry out the purposes described in this privacy notice, we will use personal identification, contact, labor and property or financial data. 
 
4.- Sensitive personal data. 
 
The owner of the information acknowledges and accepts that, due to the relationship with Gemthum, he has not provided, nor will he have to provide "sensitive personal data", that is, those personal data that affect the most intimate sphere of its owner, or whose improper use may give rise to discrimination or entail a serious risk for it. In particular, those that may reveal aspects such as racial or ethnic origin, present and future health status, genetic information, religious, philosophical and moral beliefs, union affiliation, political opinions, sexual preference are considered sensitive. 
 
In the event that the owner of the information provides "sensitive personal data", he must expressly consent in writing, through his autograph signature, electronic signature or any authentication mechanism established for this purpose, the foregoing in accordance with the Law. 
 
5.- Transfer of personal data. 
 
Your personal data will not be disclosed or shared with third parties, nor will they be used other than that indicated in point 2 above, except for the exceptions provided for in article 37 of the Law, of which the consent of the owner of the information is not required. . 
 
6.- Means and procedure to exercise the rights of access, rectification, cancellation or opposition of your personal data. 
 
You have the right to know what personal data we have about you, what we use them for and the conditions of use we give them (access). Likewise, it is your right to request the correction of your personal information in case it is outdated, inaccurate or incomplete (rectification); that we remove it from our records or databases when it considers that it is not being used in accordance with the principles, duties and obligations provided for in the regulations (cancellation); as well as oppose the use of your personal data for specific purposes (opposition). These rights are known as ARCO rights (hereinafter “ARCO Rights”). 
 
You or your legal representative may exercise any of the ARCO Rights, as well as revoke your consent for the processing of your personal data, by sending the request electronically to the Gemthum Privacy Department, request that must contain: a) name and address or another means of communicating the response to your request; b) the documents that prove the identity or, where appropriate, the legal representation; and c) the clear and precise description of the personal data with respect to which one seeks to exercise any of the ARCO Rights and any other element that facilitates the location of the personal data. 
 
To find out about the procedure and any questions about the requirements for the exercise of ARCO Rights, you can contact our Gemthum Privacy Department, who will process the requests for the exercise of these rights and will answer any questions you may have. regarding the treatment of your information. 7.- Mechanisms and procedures for revocation of consent to the processing of your personal data. 
 
You can revoke the consent that, if applicable, you have given us for the processing of your personal data. However, it is important that you bear in mind that not in all cases we will be able to attend to your request or terminate the use immediately, since it is possible that due to some legal obligation we may require to continue processing your personal data. Likewise, you must consider that, for certain purposes, the revocation of your consent will imply that we cannot continue providing the service you requested, or the termination of your relationship with us. 
 
To revoke your consent, you must submit your request in the same terms that were indicated in the previous point, establishing for this the procedure that is contemplated in said point. 
 
8.- Means to limit the use or disclosure of your personal data. 
 
You may limit the use or disclosure of your personal data by sending your request to the Gemthum Privacy Department at contacto@gemthum.com. The requirements to prove your identity, as well as the procedure to meet your request, will be governed by the same criteria indicated for the exercise of ARCO Rights. 
 
If your request is successful, the Gemthum Privacy Department will register you on Gemthum's own exclusion list, so that your personal data is not processed for the requested purposes. 
 
9.-Communication procedure regarding changes in the privacy notice. 
 
This privacy notice may undergo modifications, changes or updates derived from new legal requirements; of our own needs for the products or services we offer; of our privacy practices; Changes in our business model, or other causes. 
 
We promise to keep you informed of any changes to this privacy notice, through the Gemthum website at https://www.gemthum.com/privacy-notice. We recommend that you periodically visit this page in order to be informed if there is any change to the present. 
 
10.- General information.

If you consider that your right to the protection of your personal data has been injured by any conduct or omission on our part, or presumes any violation of the provisions set forth in the Law, its regulations and other applicable ordinances, you may file your disagreement or complaint before the Federal Institute of Access to Information and Data Protection (IFAI).
